MAPPPD Terms of Use (v 3.0, 090921)


MAPPPD is an open access decision support tool made available at www.penguinmap.com and its subdomains (e.g., www.penguinmap.com/mapppd) and designed to aid in the dissemination of penguin population data for the Antarctic continent. As such, MAPPPD data may be shared with other scientific web portals, subject to these Terms of Use.
The users of MAPPPD are strongly encouraged to cite the original data source when using data from MAPPPD.
In these Terms of Use, "user" means any individual that queries data, downloads data, and/or otherwise accesses information on MAPPPD.


General Terms

  1. MAPPPD was developed for users in the scientific, educational, and policy communities.
  2. All users of MAPPPD must abide by these Terms of Use. Any user who does not agree to these Terms of Use is prohibited from using MAPPPD.
  3. The copyright to MAPPPD is owned by Oceanites unless otherwise stated.
  4. These Terms of Use may be updated at any time; any such updated versions will be accessible on MAPPPD. A user's continued use of MAPPPD after any such update shall indicate that the user agrees to the updated Terms of Use.
  5. Oceanites also reserves the right to change MAPPPD at any time, including to make corrections or amendments.

Restrictions

  1. Users may not copy or use material or data from MAPPPD for commercial use, except for use by the media, by Antarctic expedition operators or with the express written consent of Oceanites.

Limitation of Liability

  1. Oceanites will not be liable for any damages associated with the use of MAPPPD whether based in contract, tort, strict liability or otherwise, including any direct, indirect, special, consequential or punitive damages. This includes any damages from use or loss of use, loss of data or profits arising from the use of MAPPPD.

  1. MAPPPD is made available on an "as is, as available" basis only, without warranty or guarantee of any kind.
  2. Oceanites hereby disclaims, and each user hereby waives, all representations, warranties or guarantees of any kind, including any implied warranty of merchantability, fitness for a particular purposes, non-infringement and data accuracy.
  3. While Oceanites uses reasonable efforts to include accurate and up-to-date information, Oceanites makes no warranty or guarantees as to the accuracy, completeness, currency or reliability of any materials available through MAPPPD. Use of MAPPPD is at the sole risk of the user.
  4. Oceanites does not guarantee uninterrupted service, or uninterrupted ability to access MAPPPD, or that the use of MAPPPD will be completely secure. Oceanites is not responsible for slow loading times due to any cause, including slow internet connections or sluggish computer performance on the user side.
  5. Geographic names in MAPPPD do not imply any expression of opinion by Oceanites.

Governing Law

  1. These Terms of Use are governed by the laws of the District of Columbia without any regard to its conflicts of law rules.
